Definitions

These General Terms and Conditions apply to all agreements between De Ruimte and the client (hereinafter referred to as the participant) concerning training, workshops, seminars, and other forms of education (hereinafter referred to as education).

Formation of the Agreement
The agreement is formed at the moment the participant returns the fully completed registration form and thereby agrees to these General Terms and Conditions. The General Terms and Conditions are provided to the participant simultaneously with the registration form.

Upon receipt of the digital registration, the participant will receive a confirmation of registration for the relevant educational program, as well as the corresponding invoice. The participant will also receive a copy of the registration form signed by the instructor.

The registration is final once the participant has received the aforementioned confirmation.

Options
It is possible to take an option. A place in the education program will then be reserved. This reservation is valid until four weeks before the start of the education. If the education program fills up sooner, the interested party will be contacted.

Waiting List
If the education program is fully booked at the time of registration, the participant will be placed on a waiting list. The participant will be notified of this digitally. As soon as a place becomes available, the first participant on the waiting list will be contacted.

Payment
After sending the digital registration form via the website, the participant will receive an invoice plus a letter of participation for the education for which they have registered. The registration is final once the participant has paid the registration fee. Payment must be made within 14 days. Installment payments are possible upon consultation. Payment in installments does not release participants from the obligation to pay the full tuition costs. No extra costs are charged for installment payments. Course materials are included in the price. This does not apply to mandatory and recommended literature, unless stated otherwise in the announcement.

5a. Procedure for Late or Incomplete Payment
The full amount or, if agreed, the first installment must be paid before the start of the course. If this is not the case, the following procedure applies:

• First reminder: In the event of late payment, the participant will receive a first written reminder, with a new payment term of 7 days. No extra costs are attached to this.
• Second reminder: If payment has still not been made after the first reminder, the participant will receive a second written reminder. Administration costs of €15.00 will be charged for this.
• Follow-up steps: If payment has still not been made after the second reminder, De Ruimte reserves the right to:
  • Cancel the registration for the course;
  • Recover the outstanding claim from the participant, including any statutory interest.
    The participant will be informed of this in advance.

Cancellation
Cancellation can only take place in writing or by email. The participant has the right to dissolve the agreement free of charge and without giving reasons for 14 days after concluding the agreement. If no use has been made of the above, the following rules apply:

• Cancellation up to 1 month before the start: € 25 administration costs
• Cancellation less than 1 month before the start: 50% of the educational costs
• Cancellation less than 1 week before the start: 100% of the educational costs

If the participant terminates participation after the first day of education or does not participate in the education for other reasons, the participant pays the full participation costs, including any outstanding installments of a payment plan. The participant may be replaced by another person for the duration of the entire education program, provided that this person meets the admission requirements for the specific training.

De Ruimte has the right to cancel the education—stating clear reasons—in which case the participant is entitled to a full refund of the amount paid by the participant to De Ruimte.
In the event of cancellation and entitlement to a return of the payment, the amount will be refunded to your account within 1 month.

Liability
De Ruimte will make every effort to execute the education to the best of its knowledge and ability.

De Ruimte is only liable for damage that is the direct result of intent or deliberate recklessness, but up to a maximum amount of the tuition fee per damage-causing event, whereby a successive series of events is considered as one event. De Ruimte is not liable for indirect damage such as consequential damage, lost profits, or business interruption.

De Ruimte is not liable if the possibility exists to claim against an insurance company. Participants enter the premises of De Ruimte at their own risk. De Ruimte is not liable for damage, loss, or theft of property belonging to participants in the education.

Confidentiality
Information provided by participants will be treated confidentially by De Ruimte.

Participants shall treat the information provided by the training programs confidentially. The copyright of brochures, training scripts, sheets, and other written materials issued by De Ruimte rests with De Ruimte. Published educational material is the property of the participant. Without the express written permission of De Ruimte, no data in any form whatsoever will be published from the materials or reproduced in any way by the participant.

Algemene voorwaarden

1. Definities

Deze Algemene Voorwaarden zijn van toepassing op alle overeenkomsten tussen De Ruimte en opdrachtgever (verder te noemen deelnemer) van trainingen, workshops, seminars en andere vormen van onderwijs (hierna te noemen onderwijs).

2. Totstandkoming overeenkomst

De overeenkomst komt tot stand op het moment dat de deelnemer het inschrijfformulier volledig ingevuld en retour heeft gestuurd en daarmee akkoord is gegaan met deze Algemene Voorwaarden. De Algemene Voorwaarden worden gelijktijdig met het inschrijfformulier aan de deelnemer verstrekt.

Na ontvangst van de digitale inschrijving ontvangt de deelnemer een bevestiging van de inschrijving voor het betreffende onderwijsprogramma, alsmede de bijbehorende factuur. Tevens ontvangt de deelnemer een door de docent ondertekend exemplaar van het inschrijfformulier.

De inschrijving is definitief zodra de deelnemer de hiervoor genoemde bevestiging heeft ontvangen.

3. Optie

Het is mogelijk een optie te nemen. Er wordt dan een plaats voor het onderwijs gereserveerd. Deze reservering is tot vier weken voor aanvang van het onderwijs geldig. Loopt het onderwijs eerder vol, dan wordt contact opgenomen met de belangstellende.

4. Wachtlijst

Is op het moment van de aanmelding de opleiding volgeboekt, dan wordt de deelnemer op een wachtlijst geplaatst. De deelnemer krijgt hiervan digitaal bericht. Zodra er een plaats vrijkomt, wordt de eerste op de wachtlijst geplaatste deelnemer benaderd.

5. Betaling

Na verzending van het digitale inschrijfformulier via de website ontvangt de deelnemer een factuur plus brief van deelname voor het onderwijs waarvoor is ingeschreven. De inschrijving is definitief zo- dra de deelnemer het inschrijfgeld heeft voldaan. Betaling vindt plaats binnen 14 dagen. In overleg is een gespreide betaling mogelijk. Gespreide betaling ontslaat deelnemers niet van de verplichting de volledige onderwijskosten te voldoen. Aan gespreide betaling zijn geen extra kosten verbonden. Cursusmateriaal is bij de prijs inbegrepen. Dit geldt niet voor de verplichte en aanbevolen literatuur, tenzij vermeld in de aankondiging.

5a. Procedure bij niet-tijdige of onvolledige betaling

Het volledige bedrag of indien overeengekomen het eerste termijn dient voor aanvang van de cursus te zijn voldaan. Als dat niet het geval is volgt de volgende procedure:

• Eerste herinnering: Bij niet-tijdige betaling ontvangt de deelnemer een eerste schriftelijke herinnering, met een nieuwe betaaltermijn van 7 dagen. Hieraan zijn geen extra kosten verbonden.
• Tweede herinnering: Indien de betaling na de eerste herinnering nog steeds niet is voldaan, ontvangt de deelnemer een tweede schriftelijke herinnering. Hieraan zijn administratiekosten van €15,- verbonden, die in rekening worden gebracht.
• Vervolgstappen: Wanneer de betaling na de tweede herinnering nog steeds niet is voldaan, behoudt De Ruimte zich het recht voor om:
  • De inschrijving voor de cursus in te trekken;
  • De openstaande vordering te verhalen op de deelnemer, inclusief eventuele wettelijke rente;
    De deelnemer wordt hiervan vooraf op de hoogte gesteld.

6. Annulering

Annulering kan uitsluitend schriftelijk of via email plaatsvinden. De deelnemer heeft  gedurende 14 dagen na het sluiten van de overeenkomst het recht de overeenkomst zonder opgave van reden kosteloos te ontbinden. Indien van het bovenstaande geen gebruik is gemaakt gelden de volgende regels:

• Annulering tot 1 maand voor de start: € 25 administratiekosten
• Annulering korter dan 1 maand voor de start 50% van de onderwijskosten
• Annulering korter dan 1 week voor de start: 100% van de onderwijskosten

Als de deelnemer na de eerste onderwijsdag de deelname beëindigt of om andere redenen niet aan het onderwijs deelneemt, betaalt de deelnemer de volledige deelnamekosten, ook de eventueel nog openstaande termijnen van een gespreide betaling. De deelnemer kan zich voor de duur van het gehele onderwijs laten vervangen door een ander, mits deze aan de toelatingseisen voor de betreffende training voldoet.

De Ruimte heeft het recht om – met duidelijke opgave van redenen – het onderwijs te annuleren, in welke gevallen de deelnemer recht heeft op terugbetaling van het volledige door de deelnemer aan het De Ruimte betaalde bedrag.
Bij annulering en recht op retour van de betaling, wordt het bedrag binnen 1 maand op uw rekening teruggestort.

7. Aansprakelijkheid

De Ruimte spant zich in om naar beste inzicht en vermogen het onderwijs uit te voeren.

De Ruimte is slechts aansprakelijk voor schade die het direct gevolg is van opzet of bewuste roekeloosheid, doch maximaal voor een bedrag van het opleidingsgeld per schade veroorzakend feit, waarbij een opvolgende reeks feiten als een feit worden beschouwd. De Ruimte is niet aansprakelijk voor indirecte schade zoals gevolgschade, gederfde winst of bedrijfsstagnatie.

De Ruimte is niet aansprakelijk indien de mogelijkheid bestaat een verzekeringsmaatschappij aan te spreken. Deelnemers betreden de ruimtes van De Ruimte op eigen risico. De Ruimte is niet aansprakelijk voor beschadiging, verlies of diefstal van eigendommen van deelnemers aan het onderwijs.

8. Vertrouwelijkheid

Door deelnemers verstrekte informatie wordt door De Ruimte vertrouwelijk behandeld.

Deelnemers behandelen de verstrekte informatie van de opleidingen vertrouwelijk. Het auteursrecht van door De Ruimte uitgegeven brochures, opleidingsscripts, sheets en andere schriftelijke materialen berust bij De Ruimte. Uitgegeven onderwijsmateriaal is eigendom van de deelnemer. Zonder uitdrukkelijke schriftelijke toestemming van De Ruimte zullen door de deelnemer geen gegevens in welke vorm dan ook uit de materialen worden gepubliceerd of op welke wijze dan ook worden vermenigvuldigd.
